In this new seminar, Mark Weisleder, LLB., REI, teaches what you need to know about
everything relating to boundary rights and disputes
The objectives of this course are to understand:

    a) Your rights in determining boundary and fence line issues between 2 neighbours

    b) The impact of the conversion of lands into the Land Titles system on the legal
concepts of adverse possession and easements by prescription

By the end of this session, you will have gained a comprehensive understanding of your rights under the Line Fences Act, including how boundary issues are handled and whether your city adheres to this act or follows a different process. You will learn about the implications of converting property into land titles and the distinctions between an absolute title and a conversion qualified title. The session will delve into the nuances of adverse possession, squatters’ rights, and easements by prescription, including the requirements needed to establish such claims.

Furthermore, you'll acquire the ability to interpret easements on property titles and understand the ownership and rights associated with trees that straddle boundary lines or branches that overhang your property as defined by the Ontario Forestry Act. You'll also clarify the meaning of "more or less" in the context of errors in the legal description of your property.

The intricacies of issues related to waterfront properties, shore road allowances, and the circumstances under which obtaining a survey is necessary will be explained. You'll come to understand when an estate can sell property without the mandate of probate and whether title insurance might address potential boundary issues after closing. Lastly, the session will cover what kinds of defects in title could allow a buyer to refuse to close a transaction or to demand a reduction in the purchase price.
